The purpose of this document is to make available in advance and in a transparent manner the relevant information regarding the circumstances of the processing of personal data, in an intelligible and easily accessible form.

Who is the data operator?
GYNIA SRL company headquartered in Cluj-Napoca, str. G-ral Traian Moșoiu no. 60, Cluj county, tax identification number: 16040443, hereinafter referred to as "GYNIA Hospital", is an operator regarding the personal data provided through the electronic and paper-based clinical consultation sheet, and pays close attention to the confidentiality of patient data.

What personal data do we process?
By filling in this document you provide us with the following data:

Identification data: surname, first name, personal identification number, home address, telephone number, e-mail address.

To guarantee medical services we process the following data:

Health data: Occupation and workplace, allergy predisposition, data on relevant symptoms and medical history of the patient, data on the results of medical examination, intervention and treatment proposed or performed, as appropriate.

For what purpose do we process these personal data?
GYNIA Hospital processes personal data for the following specific, explicit and legitimate purposes:

Offering medical services: for purposes related to preventive medicine, establishing a medical diagnosis, providing medical care or medical treatment or managing health systems and services according to Law no. 95/2006 regarding the healthcare reform;

Internal reporting, statistical analysis;

Fulfillment of the legal obligations of the operator, communications or reports to the authorized authorities, institutions or state or government agencies;

Resolving customer requests;

Resolving potential litigation, debt recovery;

Fulfillment of the contractual obligations towards the insurance companies.

What is the legal basis for data processing?
The processing of personal data is necessary for the conclusion and execution of the contract of which you are a party, for the fulfillment of the legal obligations incumbent upon the operator (Law no. 95/2006 on healthcare reform, Law no. 46/2003 on patient rights in particular and national legislation in the field of health in general), to serve the legitimate interest of the operator, respectively to protect the vital interests of patients.

Who do we transmit the data to?
In order to provide adequate medical services, your personal data regarding your health status will be / can be transmitted to the following collaborators of our hospital: to laboratories in order to carry out the medical analyzes prescribed by your medical advisor, to the insurance companies in order to collect the value of the medical services provided to you, to the external collaborators of GYNIA Hospital, to the stem cell banks in order to perform the services you have contracted with them, and to you when communicating the results of the medical analyzes, respectively to your relatives if they participate in the medical activity.

How and how long do we store data?
Your data are stored in electronic format in the computerized patient record system and on paper for the period necessary for the fulfillment of the mentioned purposes, respectively during the period provided by the legal provisions in force regarding the archiving of documents (Law no. 16/1996 on the Law of National Archives, Order of the Ministry of Public Finance no. 2634/2015, and - as appropriate - other provisions in the field).

What are the patient's rights regarding personal data?
Based on the provisions of the Data Protection Regulation you can exercise any of the following rights: the right to access, the right to rectify, the right to delete data, the right to restrict data processing, the right to data portability, the right to opposition, the right not to be the subject of a decision based exclusively on automatic processing, the right to file a complaint at us and / or the data protection supervisory authority, and the right to turn to the court.
